Summary, etc Das Recht einer Gesellschaft reflektiert und konditioniert ihren dialektischen Selbstwiderspruch in der Gestalt der in ihr vorhandenen Macht/Ohnmacht-Verhältnisse. Da Macht nicht nur Recht, sondern auch Unrecht macht, vermag das Recht die inner- und zwischenstaatlichen Antagonismen höchstens zu domestizieren. Es stabilisiert die in einer herrschaftsförmig organisierten Gesellschaft vorhandenen strukturellen Gewalten. Die Ungleichheit unter dem Gesetz wird, wenn die Gleichheit vor dem Gesetz sie ignoriert, bestandgeschützt. Mit dem Recht wird menschliches Verhalten legalisiert und illegalisiert. Wodurch aber wird das Recht legitimiert und illegitimiert? Auch darauf wird hier eine Antwort versucht. Besonders bedeutsam in Zeiten, da dem Rechtsstaat von einem »Unsozialstaat« und dem Völkerrecht vom Faustrecht Gefahr droht.
